General Terms and Conditions of Sale:


The general terms and conditions of sale are an integral part of the sales contract, the acceptance of which is mandatory before the conclusion of any transaction: The general conditions of sale are an integral part of the sales contract whose global acceptance is mandatory before the conclusion of any transaction. The reservation request implies the adherence to the present terms and conditions of sale and the complete and unreserved acceptance of their provisions.

Article 1 - These general conditions of sale apply to all reservations made between Finca Ardilla and its clients (individuals, travel agencies, incoming agencies or other organizations)

Article 2 - Duration of the stay: The signatory of this contract concluded for a fixed period will not be able under any circumstances to take advantage of any right to remain in the premises at the end of the stay.

Article 3 - Conclusion of the contract : The reservation becomes effective once the tenant has sent Finca Ardilla a deposit of 25% (this percentage may be increased in case of very busy periods) of the total amount of the stay with a minimum of one night per room (this percentage may be increased in case of very busy periods). The prices include all charges and taxes.

Article 4 - Cancellation by the client : Any cancellation must be notified in writing (e-mail to finca.ardilla@gmail.com)

a) Cancellation before the beginning of the stay: If the cancellation occurs more than 24 hours before the beginning of the stay, the deposit remains with the owner. If the cancellation occurs less than 24 hours before the beginning of the stay, the deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.

b) If the tenant does not show up before 7 p.m. on the day of the beginning of the stay, the present contract becomes null and void and the owner can dispose of his rooms. The deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.

c) In case of shortened stay, the price corresponding to the cost of the accommodation remains entirely acquired by the owner.

Article 5 - Cancellation by the owner: When the owner cancels the stay before the beginning of the stay, he must inform the client by e-mail. The customer, without prejudice to any recourse for damages, will be reimbursed immediately for the amounts paid.

Article 6 - Arrival : The client must arrive on the specified day and before 7pm. In case of late or delayed arrival, the customer must warn the owner by any means at his convenience.

Article 7 - Payment of the balance: The balance is to be paid on arrival at Finca Ardilla. Any additional services and consumption not mentioned initially in the reservation will be paid at the end of the stay to the owner, as well as any additional guests to the initial reservation.

Article 8 - The IVA is a local tax that the client must pay to the owner, who then transfers it to the public treasury.

Article 9 - Use of the premises: The client must respect the peaceful character of the premises and use them in accordance with their purpose. He commits himself to return the rooms in good condition.

Article 10 - Capacity: Reservations are made for a specific number of people. If the number of customers exceeds this number, the owner is able to refuse the additional customers. This refusal can in no way be considered as a modification or a breach of contract at the initiative of the owner, so that in case of departure of a number of customers higher than those refused, no refund can be considered.

Article 11 - Prices: Prices are indicated in dollars and include the services strictly mentioned in the reservation. The IVA is included in the prices indicated. To the price mentioned in the reservation will be added, at the time of invoicing, the additional services provided by the hotelier during the stay. The prices mentioned on the website are subject to change without notice and only the price indicated in the reservation confirmation is binding. In case of payment in another currency, the official exchange rate of the moment will be applied.

Article 12 - Animals : We accept animals without any extra charge. However, we must be notified in advance. In case of non information of their coming or in case of aggressive behavior of an animal, we reserve ourselves the right to refuse it. This refusal can in no way be considered as a modification or a breach of contract at the initiative of the owner, so that in case of departure of the customer, no refund can be considered.

Article 13 - Force majeure: Force majeure is any event external to the parties that is both unforeseeable and insurmountable and that prevents either the client or the hotel owner from fulfilling all or part of the obligations stipulated in the contract. It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising therefrom. The customers will bear alone the additional costs that could be incurred to allow the continuation of the trip, following the occurrence of a case of force majeure

Article 14 - Responsibility: Finca Ardilla is not responsible for the security of goods and persons within the premises. Finca Ardilla cannot be held responsible for any damage or theft of vehicles parked in or near the establishment.

Article 15 - Disputes: Any complaint regarding a stay must be submitted to Finca Ardilla within 15 days of the start of the stay, by e-mail. A response will be made as soon as possible in order to find an amicable agreement. These provisions do not prejudice any legal action taken by the client or the owner. Any dispute, claim or litigation relating to the terms and conditions of the reservation of an accommodation is subject to Costa Rican law.
